Our decision on your application

We have declined your application for a visitor visa because you do not meet the requirements set out in visitor visa immigration instructions.

The documents you have provided indicate that you and your sponsor, Robert Oldale, made acquaintance through a dating portal in September 2010 and had been communicating by e-mail and skype until you decided to meet each other.

You first met your sponsor in NZ during your first trip to New Zealand in February 2011 on a limited visa granted by this office. You spent about 3 weeks in New Zealand. However you met your sponsor for 3 days only. The time you spent together and the circumstances of your meeting do not allow us to conclude that you have been in a genuine and stable relationship at this point.

You have applied for a 4 month visit and that the purpose of your visit is to marry your sponsor. You have also indicated that once you have been granted a visa you will try to transfer to UBS New Zealand branch or otherwise you will resign. This information leads us to conclude that you do not have sufficient economic incentives to leave NZ after the expiry of any visa if it is granted to you in case your marriage does not work out in NZ as you met your fiancé for 3 days only. You had been communicating with your fiancé before your trip to NZ in 2011. However you did not declare your fiancé as a contact in the application lodged with this office in November 2011. It would appear that you misled the INZ concerning the genuine reasons for your trip in 2011 and did not declare your future fiancé even as a contact in NZ in your application. This raises a character issue under A5.45 (b).

As a result we are not satisfied that you have provided the genuine reasons for your trip to NZ and that you have strong social and economic commitments in your home country to return to.

You were informed of the potentially prejudicial information that came to light during assessment of your application. Unfortunately your comments have not lessened our concerns.

We have considered whether the imposition of a bond or the granting of a limited visa would mitigate our concerns but we do not think that they would. We have also considered whether there are any special circumstances which would warrant an exception to immigration instructions but we can find no reason to grant a visa as an exception.
